2024 Maui County Council Legislative Package
HB1874 & SB2205: Amends state boating law policy to include a provision to promote and attain every person’s right to a clean and healthful environment. Prohibits the Department of Land and Natural Resources from renewing a commercial use permit if renewal would cause nearshore water overcrowding or harm, or potential threats to, the environment.
- Background: Resolution 23-182, CD1, approving for inclusion in the 2024 Maui County Council Legislative Package a proposed State bill relating to commercial use ocean permits, as recommended by Committee Report 23-79.
HB1875 & SB2206: Repeals the maximum tax rate of the county transient accommodations tax.
- Background: Resolution 23-171, approving for inclusion in the 2024 Maui County Council Legislative Package a proposed State bill relating to the County Transient Accommodations Tax, as recommended by Committee Report 23-77.
HB1876 & SB2207: Establishes a paid family leave program for state and county employees. Authorizes a qualifying employee to take up to 12 weeks of paid leave for the birth or placement of a child or to care for a family member who has a serious health condition. Establishes procedures for a health care provider to provide a certification to an employee requesting paid family leave. Requires the State and counties to establish the paid family leave program by 1/1/2025.
- Background: Resolution 23-173, approving for inclusion in the 2024 Maui County Council Legislative Package a proposed State bill to establish paid family leave for State and County employees, as recommended by Committee Report 23-78.
HB1877 & SB2208: Amends the procurement code to require County Council approval for contracts awarded by a county under its statutory authorization for sole source procurement if the contract amount exceeds $30,000.
- Background: Resolution 23-231, approving for inclusion in the 2024 Maui County Council Legislative Package a proposed State bill relating to procurement, adopted at the December 1, 2023, Council meeting.
HB1878 & SB2209: Amends the definition of “thrill craft” in the state boating law.
- Background: Resolution 23-180, CD1, approving for inclusion in the 2024 Maui County Council Legislative Package a proposed State bill relating to thrill craft, as recommended by Committee Report 23-80.

HB111 & SB230: Authorizes each county to establish a higher minimum wage than the state minimum wage.
- Background: Resolution 22-203 approving for inclusion in the 2023 Maui County Council Legislative Package a proposed State bill to authorize counties to establish a county minimum wage by ordinance, as recommended by Committee Report 22-96.
HB112 & SB231: Repeals the minimum age requirement for individuals who become an Employees’ Retirement System member after 6/30/2012, and who have at least 25 years of credited service.
- Background: Resolution 22-200, CD1, approving for inclusion in the 2023 Maui County Council Legislative Package a proposed State bill to remove the minimum-age requirement for police-officer retirement, as recommended by Committee Report 22-94.
HB113 & SB232: Requires procurement officers, when assessing an offeror’s responsibility, to require the offeror to submit answers to questions contained in a standard questionnaire. Establishes certain questions that must be included in the questionnaire. Requires offerors to submit the questionnaire on an annual basis to be prequalified as responsible for projects by the procurement office. Provides that the information furnished in response to the questionnaire shall be available for public inspection and duplication.
- Background: Resolution 22-202, approving for inclusion in the 2023 Maui County Council Legislative Package a proposed State bill to ensure that only qualified contractors and subcontractors are awarded capital improvement projects based on past experience, quality craftwork, efficient operation, and safety, as recommended by Committee Report 22-95.
HB114 & SB233: Specifies that boards subject to the open meetings law shall allow oral testimony on any agenda item at the beginning of the board’s agenda or meeting, provided that oral testimony shall not be limited to the beginning of a board’s agenda. Specifies an exception for the legislative body of each county.
- Background: Resolution 22-199, CD1, approving for inclusion in the 2023 Maui County Council Legislative Package a proposed State bill to remove the requirement that the presentation of testimony not be limited to the beginning of a board’s agenda or meeting, as recommended by Committee Report 22-93.
