2026 Charter Amendments on the General Election Ballot Packet
2026 PROPOSED AMENDMENT TO THE COUNTY OF MAUI CHARTER
QUESTION # 1: PLANNING COMMISSION REVIEW OF GENERAL PLAN AND LAND USE ORDINANCES
QUESTION: Shall the Charter be amended, effective January 2, 2027, to provide clarity and consistency in deadlines for planning commission review of revisions to the general plan, zoning ordinances, and other land use ordinances proposed by the council, and transmittal of related findings and recommendations to the council?
EXPLANATION: Currently, the Revised Charter of the County of Maui sets deadlines for a planning commission to transmit its findings and recommendations on proposed land use ordinances and General Plan revisions to the County Council that differ from when the Council can take action on those matters if a planning commission fails to transmit its findings and recommendations. For example, section 8-8.4 of the Charter requires a planning commission to transmit its findings and recommendations on General Plan revisions to the Council within 180 days of the final public hearing on the revisions, and to transmit findings and recommendations on land use ordinances within 120 days of the final public hearing on the ordinance. However, under Section 8-8.6, the Council may approve General Plan revisions and land use ordinances if a planning commission fails to transmit its findings and recommendations within 120 days from when the Council transmits those matters to a planning commission for consideration. This amendment would adjust the time frames for Council action on land use ordinances and General Plan revisions to be consistent with the deadlines for review by a planning commission. This means that the Council could act on revisions to the General Plan if a planning commission fails to transmit its findings and recommendations after 180 days following the final public hearing on the revision. Similarly, the Council could act on land use ordinances if a planning commission fails to transmit its findings and recommendations after 120 days following the final public hearing on the ordinance. Finally, this amendment would require the planning director schedule a public hearing for any Council initiated revisions to the general plan or land use ordinance within 60 days of transmittal to the Planning Department by resolution.
MEANING OF “YES” VOTE: A “yes” vote means that a planning commission’s deadline for transmitting findings and recommendations on land use ordinances and revisions to the General Plan would be consistent with when the Council could adopt those ordinances and revisions if no findings and recommendations are transmitted. It would also establish a deadline for the Planning Director to schedule public meetings on proposed land use ordinances and revisions to the General Plan.
MEANING OF “NO” VOTE: A “no” vote means that current deadlines for planning commission review and time periods for Council action would remain unchanged.

2026 PROPOSED AMENDMENT TO THE COUNTY OF MAUI CHARTER
QUESTION # 2: STANDARDIZING DEADLINES FOR VOTER INITIATIVE, RECALL, AND CHARTER AMENDMENT
QUESTION: Shall the Charter be amended, effective January 1, 2027, to standardize the deadlines related to the clerk’s processing of petitions related to voter initiative, recall of elected officers or board or commission members, and charter amendments?
EXPLANATION: Under the Revised Charter of Maui, there are three types of petitions to have a measure placed on the ballot for consideration by voters during an election. These include petitions to amend the Maui County Code (also referred to as a “voter initiative”) under Article 11, petitions to recall elected officers or board and commission members under Article 12, and petitions to amend the Charter under Article 14. For all three types of petitions, the County Clerk is responsible for reviewing the sufficiency of the petition, including whether there are a sufficient number of valid voter signatures. Currently, the Charter establishes different deadlines for reviewing the initial petition and supplemental petitions, if any, for all three types of petitions. For voter initiatives, the County Clerk’s Office has 45 days to review the petition, and 20 days to review a supplemental petition. For petitions to recall an elected officer or board or commission member, the County Clerk’s Office has 20 days to review the petition and 10 days to review a supplemental petition. For Charter amendments, the County Clerk’s Office has 15 days to review the petition and there is no provision for supplemental petitions. This amendment would standardize the review period for all three types of petitions to 45 days. The amendment would also increase the review period for supplemental petitions for voter initiatives and recall of an elected officer or board or commission member to 30 days.
MEANING OF “YES” VOTE: A “yes” vote means that the County Clerk’s deadlines for reviewing the initial petitions for voter initiatives, recall of elected officers or board or commission members, and charter amendments would be standardized at 45 days, and the deadline for review of supplemental petitions for voter initiatives and recall of elected officers or board or commission members would be increased to 30 days.
MEANING OF “NO” VOTE: A “no” vote means that the existing deadlines for reviewing petitions for voter initiatives, recall of elected officers or board or commission members, and charter amendments would remain unchanged.

2026 PROPOSED AMENDMENT TO THE COUNTY OF MAUI CHARTER
QUESTION # 3: COMPUTATION OF TIME
QUESTION: Shall the Charter be amended, effective January 1, 2027, to establish a formula for computing Charter deadlines that excludes weekends and holidays?
EXPLANATION: The Revised Charter of the County of Maui sets various deadlines and time periods in which actions must be taken. On occasion, those deadlines or the end of those time periods fall on days when the County is not open for business, such as Saturdays, Sundays, and holidays. This amendment would adopt a formula for determining deadlines and time periods in the Charter which excludes the first day and includes the last day, unless the last day falls on a Saturday, Sunday, or holiday, in which case the deadline or time period would be extended until 4:30 p.m. on the next business day. This formula would be used to determine all deadlines and time periods in the Charter other than those containing a specific date, or those related to vetoing and overriding vetoes on legislation.
MEANING OF “YES” VOTE: A “yes” vote means that, unless the Charter specifies a date, or the Charter provision concerns vetoing or overriding a veto on legislation, deadlines and time periods contained in the Chart would be calculated by excluding the first day and including the last day of the period, unless the last day falls on a Saturday, Sunday, or holiday.
MEANING OF “NO” VOTE: A “no” vote means that deadlines or time periods established by Charter would continue to be calculated as written regardless of whether the deadline or last day of the period fell on a day in which the County was not open for business.
MEANING OF BLANK VOTE OR OVERVOTE: Neither a “blank” vote nor an “over” vote is tallied as a “yes” vote or a “no” vote and are only counted toward the total number of votes cast.

QUESTION # 4: PROCESSING OF CLAIMS
QUESTION: Shall the Charter be amended, effective January 1, 2028 to streamline the process for filing claims for personal injury or property damage by requiring that claims are filed directly with the Director of Finance or as provided by ordinance?
EXPLANATION: Currently, Section 13-6 of the Revised Charter of the County of Maui requires that any claims for personal injury or property damage made against the County of Maui must be filed with the Office of the County Clerk. This amendment would require that these claims be filed with the Director of Finance or another individual designated by ordinance instead.
MEANING OF “YES” VOTE: A “yes” vote means that claims for personal injury or property damage made against the County of Maui would be filed directly with the Director of Finance or another individual designated by ordinance instead of the County Clerk.
MEANING OF “NO” VOTE: A “no” vote means that claims for personal injury or property damage made against the County of Maui would continue to be filed with the County Clerk.

QUESTION # 5: REMOVING THE ENGLISH TRANSLATION OF THE HAWAIʻI STATE MOTTO
QUESTION: Shall the Charter be amended, effective upon passage, by removing the English translation of the Hawaiʻi State motto in the Maui County Charter Preamble, allowing the original phrase, “Ua mau ke ea o ka ʻāina i ka pono,” to stand on its own?
EXPLANATION: Currently, the Revised Charter of the County of Maui Preamble includes the Hawaiʻi State motto, “Ua mau ke ea o ka ʻāina i ka pono,” followed by the English translation, “The life of the land is perpetuated in righteousness” in parenthesis. This amendment would remove the English translation and keep only the Hawaiian-language phrase.
MEANING OF “YES” VOTE: A “yes” vote means that the English translation of the Hawaiʻi State motto would be removed from the Charter Preamble, and the original Hawaiian-language phrase would remain.
MEANING OF “NO” VOTE: A “no” vote means that the Charter Preamble would continue to include both the Hawaiʻi State motto and its English translation.

2026 PROPOSED AMENDMENT TO THE COUNTY OF MAUI CHARTER
QUESTION # 6: EMERGENCY APPROPRIATIONS
QUESTION: Shall the Charter be amended, effective January 2, 2027, to allow the Mayor, with approval from the Council, to pass an emergency appropriation for an application for a line of credit and clarify that the one percent limitation for emergency appropriations does not apply to funds that have already been allocated to an emergency fund?
EXPLANATION: Section 9-9 of the Revised Charter of the County of Maui allows the County to make emergency appropriations to respond to a public emergency threatening life, health and property by ordinance, and specifies that emergency appropriations in a fiscal year may not exceed 1% of the total operating budget for that year. Currently, when there are not enough funds to cover these emergency appropriations, the Council may authorize the issuance of emergency notes. This amendment would remove authorization for issuance of emergency notes, and instead allow the County to apply for a line of credit with Council approval. The Amendment would also clarify that the 1% limitation on emergency appropriations does not include money that has already been allocated in an emergency fund.
MEANING OF “YES” VOTE: A “yes” vote means that the County could apply for a line of credit instead of issuing emergency notes when there are not enough funds to cover emergency appropriations, and that funds already appropriated into an emergency fund would not count toward the 1% Charter limit on emergency appropriations.
MEANING OF “NO” VOTE: A “no” vote means that the Charter would continue to authorize the issuance of emergency notes for emergency borrowing and would not specify whether funds that have already been appropriated into an emergency fund count toward the 1% limitation on emergency appropriations.

2026 PROPOSED AMENDMENT TO THE COUNTY OF MAUI CHARTER
QUESTION # 7: INDEPENDENT NOMINATION BOARD
QUESTION: Shall the Charter be amended, effective immediately, to repeal the parts of the 2022 Charter amendment that created the Independent Nomination Board and related procedures for nominations for various County officers?
EXPLANATION: In 2022 the voters of Maui County approved a Charter Amendment establishing the Independent Nomination Board to recruit, evaluate, and nominate candidates for various County boards and commissions, as well as the County Clerk, the County Auditor, the Corporation Counsel, and the Prosecuting Attorney. Nominees for these positions are selected from a list provided by the Independent Nomination Board, unless the Independent Nomination Board fails to meet various deadlines. This amendment would dissolve the Independent Nomination Board and revert to prior methods of nomination and approval for these positions. As a result, the mayor would be able to nominate individuals to fill vacancies on a County board or commission, the Corporation Counsel and the Prosecuting Attorney without having to choose from a list of potential nominees provided by the Independent Nomination Board. The amendment would also allow the Council to appoint the County Clerk and the County Auditor without having to choose from a list of potential nominees provided by the Independent Nomination Board. In addition, the amendment would: amend deadlines for the mayor to submit nominations for boards and commissions to the Council; amend deadlines for the Council to act on nominations to boards and commissions submitted by the Mayor before they are automatically approved; allow the Council to adopt additional policies on the process for filing vacancies on boards and commissions by ordinance; allows the terms of members on boards and commissions to be set by ordinance; and removes the requirement that notice of public board and commission meetings be published in a newspaper and instead allows for notice to be provided as required by state law.
MEANING OF “YES” VOTE: A “yes” vote means that the Independent Nomination Board would be dissolved and the mayor would have authority to nominate members of boards and commissions, as well as the Corporation Counsel, and the Prosecuting Attorney, without having to choose from a list of potential nominees provided by the Independent Nomination Board. The County Clerk and County Auditor would be appointed by the Council without having to choose from a list of potential nominees provided by the Independent Nomination Board. It would also change various deadlines related to the nomination process and allow the Council to adopt additional policies related to boards and commissions by ordinance.
MEANING OF “NO” VOTE: A “no” vote means that the Independent Nomination Board and the nomination procedures adopted through the 2022 Charter amendment would remain in effect. Appointments to boards and commissions as well as for the County Clerk, the County Auditor, the Corporation Counsel, and the Prosecuting Attorney would continue to be subject to the existing Independent Nomination Board process.

2026 PROPOSED AMENDMENT TO THE COUNTY OF MAUI CHARTER
QUESTION # 8: REAPPOINTMENT OF MEMBERS OF THE BOARD OF ETHICS
QUESTION: Shall the Charter be amended, effective upon approval, to authorize the Mayor to reappoint members of the Board of Ethics of the County of Maui, with the approval of the Council, for one successive term without an intervening waiting period?
EXPLANATION: Currently, Article 13, Section 13-2(5) of the Revised Charter of the County of Maui provides that no member of a board or commission is eligible for a second appointment to the same board or commission until two years after the expiration of their prior term, unless the initial term is three years or less. This amendment seeks to create an exception for members of the Board of Ethics by allowing reappointment for one successive term without an intervening waiting period.
MEANING OF “YES” VOTE: A “yes” vote means that the members of the Board of Ethics could be reappointed for one successive term without an intervening waiting period. The existing reappointment restrictions for other boards and commissions would remain unchanged.
MEANING OF “NO” VOTE: A “no” vote means that the members of the Board of Ethics would continue to be ineligible for reappointment to the Board of Ethics until two years after the expiration of their prior term, unless their initial term was three years or less.

Duties:

- Oversight of the Office of the Mayor (except the Office of Economic Development and Community Development Block Grant Program, and as it relates to energy and climate change), Department of the Corporation Counsel, Department of Management (except the Principal Archaeologist), Department of Liquor Control, Department of the Prosecuting Attorney, Office of Council Services, and Office of the County Clerk.
- Issues involving the responsibilities of two or more standing committees.
- Implementation of the following General Plan objective:
